30 Year Transferable Limited Warranty

New Frontier Industries, Inc. ("NFI") warrants to the original consumer ("Consumer") that, for a period of thirty (30) years from the date of Consumer's purchase, under normal use, NFI products shall be free from material defects in workmanship and materials, and shall not delaminate, check, splinter, rot or experience structural damage from termites or fungal decay. If a defect occurs within the warranty period, upon notification to NFI and inspection by NFI, NFI shall, at its option, correct or repair the defect, replace the product or refund the proportional cost of the product as paid by the Consumer, exclusive of freight and installation costs. NFI shall not be responsible for freight or delivery charges of replacement product.

NFI warrants that no additional preservatives are necessary and that normal cleaning with water and household cleansers will not harm NFI products.

This warranty shall not cover and NFI shall not be responsible for costs and expenses incurred with respect to the removal of defective NFI products or the installation of replacement materials, except that NFI will take back and recycle the defective products at no cost to the Consumer upon the request of the Consumer.

At any time that Consumer removes the product from Consumer's property, NFI will accept the material for recycling upon request of Consumer.

This warranty may be transferred to subsequent buyers of the property that have NFI products installed on them.

To make a claim under this limited warranty, Consumer shall send to NFI, within the warranty period referred to above, a description of the claimed defect and proof of purchase, to New Frontier Industries, Inc., PO Box 1360, Milton, NH 03851.

NFI does not warrant against and is not responsible for any condition attributable to: accident; improper installation, maintenance, alteration or repair of NFI products; use of NFI products beyond normal use, contrary to installation instructions, or in an application not recommended by NFI's guidelines and local building codes; movement, distortion, collapse or settling of the ground or the supporting structure on which NFI products are installed; cosmetic damage including gouges, scratches, or staining; any act of God (such as flooding, hurricane, earthquake, lightning, etc.); variations or changes in color of NFI products; or improper handling, storage, abuse or neglect of NFI products by Consumer or third parties.

This Warranty constitutes the entire scope of representations made by NFI and its agents and NFI shall not be bound by any other written or oral representations made by any other person or entity. This warranty may not be altered or amended except in a written instrument signed by NFI and Consumer.

EXCEPT AS SET FORTH ABOVE, THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO NFI PRODUCTS. NFI EXPRESSLY EXCLUDES AND DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANTABILITY AND ANY WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, APPLICATION OR USE. UNDER NO CIRCUMSTANCES WILL NFI BE LIABLE FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOST PROFITS, OR LEGAL FEES, WHETHER SUCH DAMAGES ARE SOUGHT IN CONTRACT, IN TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE AND STRICT LIABILITY) OR OTHERWISE, AND NFI'S LIABILITY WITH RESPECT TO DEFECTIVE PRODUCTS SHALL IN NO EVENT EXCEED THE REPLACEMENT OF SUCH PRODUCTS OR REFUND OF THE PURCHASE PRICE, AS DESCRIBED ABOVE.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
